These Terms govern your use of Homestead, an app published by NYRAI LLC ("we", "us"). By using Homestead you agree to these Terms and to our Privacy Policy. Your license to use the app is governed by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"); these Terms are additional terms between you and NYRAI LLC. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA governs the license and these Terms otherwise apply.
We grant you a personal, non-transferable, revocable license to use Homestead on Apple devices you own or control, in accordance with the Apple Standard EULA and the App Store Terms of Service.
You acknowledge that these Terms are between you and NYRAI LLC only, and not with Apple, and that Apple is not responsible for Homestead or its content. Apple has no obligation to furnish any maintenance or support for the app. Apple provides no warranty for the app; in the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, or consumer-protection claims, or any claim that the app fails to conform to any legal requirement or infringes third-party intellectual-property rights; the handling of such claims is governed by these Terms and is NYRAI LLC's responsibility to the extent required by law. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
Homestead is free to download and includes a free tier. Homestead Premium is an auto-renewing subscription offered at $6.99/month or $49.99/year (prices may vary by region); a one-time Lifetime unlock is also available for $99, and optional Cloud-AI credit packs ($4.99 for 50) top up Premium's monthly Cloud-AI allowance. Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Manage or cancel any time in your Apple Account settings. Any unused portion of a free period is forfeited when you purchase a subscription.
Your documents and data are yours and remain on your device. You are responsible for keeping your own backups.
Homestead is provided "as is" without warranties of any kind. To the maximum extent permitted by law, NYRAI LLC is not liable for any indirect, incidental, or consequential damages, or for any loss of data, or for any decision made in reliance on data the app extracted, estimated, or displayed, arising from your use of the app. Our total liability is limited to the amount you paid for the app in the 12 months before the claim.
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute not subject to mandatory consumer-protection law in your place of residence. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
